帰化 (naturalization) is the way for a foreign national to acquire Japanese nationality. Unlike permanent residency, which only changes the status of residence, after naturalization the person becomes a Japanese national and is no longer subject to residence control under the 入管法 (Immigration Control and Refugee Recognition Act). Based on the 法務省 (Ministry of Justice) pages 「国籍Q&A」 (Nationality Q&A) and 「帰化許可申請」 (application for permission for naturalization) and the text of the 国籍法 (Nationality Act), this article summarizes the general conditions, simplified naturalization, where to apply and the process. It is intended for people who are considering naturalization and want to understand the requirements first.

Key points

  • Naturalization requires the permission of the Minister of Justice (Article 4 of the 国籍法); once permitted, it is announced in the 官報 (Official Gazette) and takes effect from the date of the announcement (Article 10).
  • Article 5 of the 国籍法 sets out six general conditions: having had an address in Japan continuously for 5 years or more; being 18 or older and having legal capacity under the law of one's home country; being of good conduct; being able to make a living; being stateless or losing one's original nationality through naturalization; and not having plotted to destroy the Constitution or the government by violence, etc.
  • 法務省 further explains that the applicant must also integrate into Japanese society, including having the Japanese ability needed for daily life (conversation, reading and writing) and having resided in Japan for 10 years or more.
  • Applications are made at the 法務局 (Legal Affairs Bureau) or 地方法務局 (District Legal Affairs Bureau) (including branch offices that handle nationality matters) with jurisdiction over the applicant's address; applicants aged 15 or older must go in person and apply in writing, and there is no fee.
  • The required documents vary by nationality, family relationships and occupation, and the official guidance asks applicants to consult the 法務局・地方法務局 before applying; there is no official standard processing period.

General conditions: Article 5 of the 国籍法

Article 5, paragraph 1 of the 国籍法 provides that the Minister of Justice may permit naturalization only for foreign nationals who meet the following conditions. 法務省 explains that these are minimum conditions, and meeting them does not mean that permission will be granted.

Condition Provision Key points of 法務省's explanation
Address condition Item 1 Having lived in Japan continuously for 5 years or more up to the time of application; the address must be lawful, and the applicant must hold a proper status of residence
Capacity condition Item 2 Being 18 or older and having also reached the age of majority under the law of one's home country (changed from "20 or older" to "18 or older" from April 1, 2022)
Conduct condition Item 3 Being of good conduct; judged according to generally accepted social norms, using the ordinary person as the standard, taking into account comprehensively whether there is a criminal record and its circumstances, tax payment status, whether the person has caused trouble to society, etc.
Livelihood condition Item 4 Not being in difficulty and being able to live in Japan; judged on the basis of the relatives sharing a livelihood, and even if the applicant has no income, the condition can be met if they can live stably on the assets or skills of relatives such as a spouse
Condition preventing dual nationality Item 5 Being stateless, or, in principle, losing one's existing nationality through naturalization; if the original nationality cannot be lost by the person's own will, permission may be granted as an exception (Article 5, paragraph 2)
Condition of respecting the Constitution Item 6 Permission is not granted to anyone who has plotted or advocated the destruction by violence of the Constitution of Japan or the government established under it, or who has formed or joined such an organization

Requirements beyond the statute

「国籍Q&A」 states that applicants also need to integrate into Japanese society, including having the Japanese ability needed for daily life (conversation, reading and writing) and having resided in Japan for 10 years or more. The leaflet (リーフレット) of the 法務省民事局 (Civil Affairs Bureau of the Ministry of Justice) lists the same points and notes that applicants must pledge to observe the laws of Japan, among other things.

Simplified naturalization: relaxations under Articles 6 to 8

For foreign nationals with a special relationship with Japan, Articles 6 to 8 of the 国籍法 relax some of the conditions (commonly called "simplified naturalization"). By provision, they are as follows:

Article 6 (relaxes the address condition in Article 5, paragraph 1, item 1; the person must currently have an address in Japan)

  • A child (excluding an adopted child) of a person who was formerly a Japanese national, who has had an address or residence in Japan continuously for 3 years or more;
  • A person born in Japan who has had an address or residence in Japan continuously for 3 years or more, or whose father or mother (excluding adoptive parents) was born in Japan;
  • A person who has had a residence in Japan continuously for 10 years or more.

Article 7 (spouses of Japanese nationals; relaxes the item 1 address condition and the item 2 capacity condition)

  • Having had an address or residence in Japan continuously for 3 years or more and currently having an address in Japan;
  • Or, 3 years or more having passed since the marriage and having had an address in Japan continuously for 1 year or more.

Article 8 (relaxes items 1 and 2 and the item 4 livelihood condition)

  • A child (excluding an adopted child) of a Japanese national who has an address in Japan;
  • An adopted child of a Japanese national who has had an address in Japan continuously for 1 year or more and was a minor under the law of their home country at the time of adoption;
  • A person who formerly lost Japanese nationality (excluding those who lost it after naturalization) and who has an address in Japan;
  • A person born in Japan who has been stateless since birth and has had an address in Japan continuously for 3 years or more since then.

In addition, Article 9 provides that a foreign national who has rendered especially meritorious service to Japan may be permitted to naturalize, with the approval of the Diet, regardless of the restrictions in Article 5, paragraph 1. Whether you fall under any of the above relaxations should be confirmed with the 法務局 during the prior consultation.

Where and how to apply

According to 法務省's 「帰化許可申請」 page:

  • Where to submit: the 法務局 or 地方法務局 (including branch offices that handle nationality matters) with jurisdiction over the applicant's address. 「国籍Q&A」 notes that some 法務局 sub-branch offices (出張所) and similar offices do not handle nationality matters.
  • How to submit: the applicant if aged 15 or older, or a legal representative such as a person with parental authority or a guardian if under 15, must go in person and apply in writing.
  • Fee: none.
  • Application form: available at the place of submission; various documents are required in addition to the application form, having all the documents does not necessarily mean permission will be granted, and the official guidance asks applicants to consult the place of submission before applying.
  • Reception hours, examination criteria, standard processing period: check reception hours with the place of submission; the page states that both examination criteria and standard processing period are 「ありません」 (none).

Main documents

The main documents listed in 「国籍Q&A」 are: the 帰化許可申請書 (application for permission for naturalization, with photo), an outline of relatives, the 帰化の動機書 (statement of reasons for naturalization), a résumé, an outline of livelihood, an outline of business, the 住民票の写し (copy of resident record), proof of nationality, proof of family relationships, tax payment certificates and proof of income.

Proof of nationality and proof of personal status must, in principle, be issued by the authorities of the home country. The 法務省 leaflet gives the following examples for applicants of Chinese nationality: for proof of nationality, a nationality certificate issued by the embassy or consulate in Japan, or a household register transcript (full transcript) issued in the home country; for proof of family relationships, notarial certificates or household register and removed household register transcripts (full transcripts) issued in the home country. The leaflet also lists: the 源泉徴収票 (withholding tax statement) etc. for company employees, income tax payment certificates etc. for self-employed people, corporate tax payment certificates etc. for company managers, and proof of social insurance premium payment (被保険者資格情報 (insured person eligibility information), pension premium receipts, etc.). Documents in languages other than Japanese must be accompanied by a Japanese translation stating the translator.

Because a family register (戸籍) will be created for the applicant after permission is granted, documents proving personal status must also be submitted with the application. The specific list varies by person; follow the 法務局's explanation.

Timeline

The approximate process shown in the 法務省 leaflet:

  1. Consultation: consult the 法務局・地方法務局 with jurisdiction over your address and confirm the required documents.
  2. Preparing documents: prepare the application form and other documents yourself, and obtain certificates from authorities in your home country and in Japan.
  3. Application: go to the 法務局・地方法務局 in person to submit.
  4. Document check and acceptance → examination.
  5. Forwarding to 法務省 for examination → decision by the Minister of Justice.
  6. Result: if permitted, it is announced in the 官報 and the 法務局 notifies the applicant; if not permitted, the 法務局 notifies the applicant.

No official standard processing period has been published, so check the overall time required with the counter.

Common misconceptions

  • "Meeting the six conditions in Article 5 means approval": 法務省 clearly explains that these are only minimum conditions, and meeting them does not necessarily lead to permission.
  • "Living in Japan for 5 years is enough": the statutory address condition is 5 years, but 「国籍Q&A」 also states requirements for integration into society such as residence of 10 years or more and Japanese ability, which should be checked together before applying.
  • "Family members or a company can submit on my behalf": applicants aged 15 or older must go to the 法務局・地方法務局 in person and apply in writing.
  • "Naturalization and permanent residency are the same thing": permanent residency is one of the statuses of residence and remains subject to residence control under the 入管法; naturalization means acquiring Japanese nationality.
